BUYING OFF-PLAN OR NEW-BUILD

Know what you are relying on before you pay.

When much of the price is paid before title is transferred, the contract and the evidence behind each payment matter. We help you gather that evidence and prepare the right questions for our lawyer, who advises on the contract. We cannot guarantee that a developer will perform or repay.

  1. 01

Ask what objective evidence will confirm each construction or approval milestone before an instalment falls due.

  2. 02

Ask whether any escrow, bank guarantee or other security protects payments made before transfer.

  3. 03

Ask what happens to your payments if approvals, completion or foreign-ownership registration cannot be achieved.

BEFORE YOU TAKE OVER

Handover without surprises.

Completion and handover can move quickly, sometimes while you are abroad. We help you prepare so that defects and costs are recorded before ownership is registered.

  1. 01

Check whether the contract treats a missed inspection period as acceptance, and ask our lawyer how your defect and warranty rights are protected.

  2. 02

Arrange an authorised representative or independent inspector to attend if you cannot.

  3. 03

Prepare a written snagging list for the developer to acknowledge, with a timetable for repairs.

BUYING A HOUSE OR LAND

Line up the title and the building together.

Points to line up for a house or land purchase

  1. 01

Land title: confirm the title deed with the Land Office, the registered owner, the boundaries and any mortgage or other registered right.

  2. 02

The house: check the house registration book and the building permit, and whether the building matches the approved plans, noting any extension or alteration.

  3. 03

Ownership structure: the registered landowner, the building owner and a leaseholder can be different people. How your interest will be held, and who pays, is a question for our lawyer before you commit.

  4. 04

Estate or village: ask who owns and maintains the roads and common areas, and what fees are outstanding.

  5. 05

Closing: ask how an existing mortgage will be discharged and the title transferred on the day, with our lawyer attending the Land Office.

Our lawyer advises on title, ownership structure and the contract; our technical specialists assess the building where included. We coordinate the documents, access and appointments.

RESALE CONDO OR BUYING FROM ABROAD

Check the unit, the building and the paperwork.

Before you sign a reservation or pay a deposit

  1. 01

Contact us before you sign a reservation or booking agreement, or pay any non-refundable deposit.

  2. 02

Send us the reservation or booking terms so our lawyer can review them, including what happens to your deposit.

  3. 03

Ask the seller or agent for a copy of the unit’s title deed, proof of the seller’s identity and authority to sell, and the floor plan.

  4. 04

Send us any draft sale and purchase agreement as soon as you receive it.

Points to line up for a resale condo

  1. 01

Seller and title: confirm the seller’s authority to sell, the unit’s ownership record and any registered mortgage or other right.

  2. 02

Foreign ownership: ask our lawyer to confirm that the building has quota available for foreign ownership.

  3. 03

Fees and arrears: ask the juristic person for a current fee statement and a debt-free certificate, and whether the sinking fund and any other charges are paid up to date.

  4. 04

From abroad: arrange authorised viewings, a power of attorney where needed, prepared by our lawyer, and payment records that identify the unit.

If the unit is occupied or sold on instalments

  1. 01

Occupied unit: ask for the current lease, the deposit amount and who will hold or return it, and when the tenant is due to leave.

  2. 02

Inspection access: agree a visit time with the owner and the tenant before you travel, since an occupied unit is often shown only with notice.

  3. 03

Special assessments: ask the juristic person about any approved or planned special charge, major repair or debt.

  4. 04

Seller-financed instalments: ask when title transfers, who holds it until the last payment and what happens if either side defaults. Our lawyer reviews the terms.

If the unit is sold on a long-term lease

  1. 01

Term and renewal: ask for the total term, any right to renew and its price, and what happens when the lease ends.

  2. 02

Registration: ask our lawyer how the lease will be registered at the Land Office, and for what term, because registration affects how the lease is protected.

  3. 03

Land and building: ask who owns the land and the building, and whether the owner can sell or mortgage them during your lease.

  4. 04

Transfer and exit: ask whether you can sell, sublet or pass on the lease, what consent or fee applies, and what happens to your payments if either side defaults.

Rental-return and furniture packages are separate agreements. Ask our lawyer to read their terms, and who stands behind any guaranteed payment, before you rely on them.

DEVELOPER & PROJECT RESEARCH

Understand the information
behind the project.

We gather available background information about the developer or project, review the information supplied and follow up claims or gaps that matter to your decision. Your summary identifies sources, dates and questions still to resolve.

Legal status, authority to sell and ownership questions are referred to our lawyer for professional verification. Research is not a guarantee of a developer’s future performance.

YOUR PROPERTY. YOUR EXISTING TEAM.

Keep your agent.
Add the support you need.

We support the home you have already chosen and can work alongside your agent, developer, lawyer and building management. A standard visit records visible observations; legal title, structural condition and investment value require the appropriate professional assessment.

CLEAR FROM THE START

Your plans.
Your scope and quote.

We agree the tasks, visits, reports and timing before work begins, with Baanward as your main point of contact throughout. Your quote includes Baanward’s fee and all specialist fees for the agreed scope, including our lawyer’s agreed work where legal review is included. Any additional work or spending requires your approval. Repairs, materials and services outside the agreed scope are quoted before you approve them.

One quote for your agreed service.

Are legal and technical specialist fees included?

Your total quote includes their fees for the agreed work. Our lawyer’s separate legal engagement defines their responsibilities to you; it does not mean an additional fee for that same work. We confirm any additional work and costs for your approval before proceeding.

If my contract promises a refund, do I still need due diligence?

A contract remedy and verification do different jobs. A refund promise is only as strong as the seller’s ability to pay it, and a title or approvals check shows the position at the time it is made, so checks can be repeated before key payments or transfer where you want that. Our lawyer advises on your contract rights. We cannot guarantee any outcome.

Can I buy with a Thai partner or family member?

Our lawyer advises before you commit on whose name goes on the title, who pays and how, and what each person’s rights will be. We cannot promise how an ownership arrangement will protect you, and we do not arrange nominee structures.

Who follows up amendments with the developer?

Our lawyer advises which amendments are worth requesting. With your approval, we relay your requests, track the developer’s replies and return the revised contract to our lawyer to check. Any negotiation or representation needs a specifically agreed mandate.

Can someone inspect my condo at handover if I cannot attend?

Yes, where agreed and available. We can arrange an authorised representative or independent specialist, subject to the developer’s access and any contract requirements. Our lawyer advises how inspection deadlines affect your rights. A handover visit is not a structural survey unless our technical specialist’s assessment is agreed.
